| Business Interruption. Record store was flooded on Christmas Eve as a result of a burst city water main, resulting in severe damage to store inventory. Store was shut down for three months for repairs and refurbishment. On behalf of city, reviewed plaintiff's business interruption claim and questioned plaintiff's lost profits analysis. Store had only been marginally profitable prior to flood, and projected profits after the flood were substantial. Resulted in significant reduction in award at time of mediation. Landlord - Tenant Dispute. Children's wear shop entered into lease agreement with landlord, a resort hotel, to open a second children's wear shop in hotel. Landlord made material misrepresentations to tenant. Tenant sued hotel for fraud, negligent misrepresentation, breach of oral contract and other causes of action. Performed calculation of tenant's lost profits, based on financial history of plaintiff's first shop and representations made by hotel. Deposition and trial testimony at jury trial. Assistance with preparation of cross-examination of landlord's expert accountant. Landlord - Tenant Dispute. Retailer of imported goods opened a second store in a new community shopping center.
